What are SB-721 and SB-326?

These are California State Bills that were developed as a response after a deadly collapse of a balcony in Berkeley, California in June 2015 - 6 students died, and 7 were injured. These laws mandate regular inspections to prevent similar incidents and ensure that such structures are safe and up to code.

What do Senate Bills 721 and 326 require?

SB 721- For apartment buildings, legislation requires any multi-family with three or more (3+) dwelling units to complete an inspection of all Exterior Elevated Elements (EEE) by January 1, 2025, and every 6 years thereafter.

SB326- For Condominium HOA’S, legislation requires an inspection of all Exterior Elevated Elements (EEE) to be completed by January 1, 2025, and every 9 years thereafter

What are Exterior Elevated Elements (EEE)?

An exterior elevated element refers to structures such as balconies, decks, porches, stairways, walkways, and entry structures that extend beyond a building’s exterior walls. These structures, designed for human occupancy or use, have walking surfaces elevated more than six feet above ground level and depend significantly on wood or wood-based products for their structural support or stability.
